Item (1) of this section is revised to state expressly
that the designation must be in writing. This
requirement is implicit in the requirements that the
designation contain certain information and that a
copy be filed for publication.

The last phrase of the first sentence of former Art.
41, § 15C(b), which referred to "publication in the
Maryland Register", now appears in § 7-206 of this
article.

8-305. ORGANIZATIONAL CHART.

ON OR BEFORE THE 1ST DAY OF EACH REGULAR SESSION OF THE
GENERAL ASSEMBLY, THE SECRETARY OF EACH PRINCIPAL DEPARTMENT AND
THE HEAD OF EACH OTHER UNIT IN THE EXECUTIVE BRANCH OF THE STATE
GOVERNMENT THAT IS NOT IN A PRINCIPAL DEPARTMENT SHALL SUBMIT,
SUBJECT TO § 2-1312 OF THIS ARTICLE, TO THE GENERAL ASSEMBLY:

(1) AN ORGANIZATIONAL CHART THAT:

(I)   SHOWS THE MAJOR SUBUNITS IN THE UNIT;

(II)   LISTS THE NAME AND TITLE OF EACH
INDIVIDUAL WHO HEADS A SUBUNIT; AND

SUBUNIT; OR

(III) DESCRIBES CONCISELY THE FUNCTIONS OF EACH

(2) IF AN ORGANIZATIONAL CHART IS ON FILE WITH THE
DEPARTMENT OF LEGISLATIVE REFERENCE, EACH CHANGE SINCE THE LAST
CHART WAS FILED.

REVISOR'S NOTE: Item (1) of this section is new language
added to account for units that, e.g., have been
created since January 1, 1974. This item is based on
former Art. 41, § 3A(c)(l), which required submission
of this chart by "January 1, 1974" and, therefore, is
deleted as obsolete. However, former Art. 41, §
3A(c)(2) imposed a continuing duty to keep the
"previously submitted chart" current. The duty to
file corrections to a chart would be meaningless
unless a unit also had a duty to file the chart
initially.

Item (2) of this section is new language derived
without substantive change from former Art. 41, §
3A(c)(2).

In the introductory clause of this section, the
language "subject to § 2-1312 of this article" is
substituted for the former requirement to file a
separate copy of the changes with the Department of
