(1) EACH ISSUE OF THE REGISTER SHALL CONTAIN A
CERTIFICATION OF THE ADMINISTRATOR THAT THE ISSUE CONTAINS ALL OF
THE DOCUMENTS THAT HAVE BEEN SUBMITTED TO THE DIVISION AS OF THE
CLOSING DATE AND HOUR OF THE ISSUE.
(2) THE CERTIFICATION OF THE ADMINISTRATOR IN THE
REGISTER IS CONCLUSIVE EVIDENCE OF THIS FACT.
(C) REIMBURSEMENT.
(1) IF THE COMMITTEE PERMITS A UNIT TO PUBLISH A
DOCUMENT IN THE REGISTER AND PUBLICATION OTHERWISE WOULD NOT BE
REQUIRED, THE COMMITTEE MAY REQUIRE THE UNIT TO REIMBURSE THE
DIVISION FOR THE COST OF THE PUBLICATION.
(2) THE DIVISION SHALL BILL FOR AND COLLECT THE
REIMBURSEMENT.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §
256F(b)(l), (2), (4) through (10), (12), and the first
clause of (3), (c)(2) and (l)(ii) and the second
clause of (i), § 256K(e) as that subsection related to
§ 256F(b), the first and second sentences of § 256N, §
256-O(a)(2) as that paragraph related to the Register,
and the last phrase of the first sentence of § 15C(b).
In subsection (a)(2)(x) of this section, the former
clause "whether or not requiring approval by ... both"
is deleted as surplusage.
In subsection (a)(2)(xi) of this section, the defined
term "regulation" and the reference to "proposed
adoption of the regulation" are substituted for the
former reference to "proposed agency rule making or
repeal", for clarity and brevity. The latter
substitution reflects that repeal of a regulation is
effected by adoption of another regulation and
encompasses amendment of existing regulations.
In subsection (a)(2)(xiii) of this section, the phrase
"unless otherwise exempted" is added to reflect that,
e.g., under § 10-114 of this article, publication of
the text of a regulation is not always required.
In subsection (a)(2)(xiv) of this section, the former,
specific reference to a document that "the General
Assembly requires" to be published is deleted as
unnecessary since subsection (a)(2)(xiii) of this
section does not limit the source that requires
publication. Similarly, former Art. 41, §
256F(b)(ll), which referred to documents required to
be published by "Article 21 (Procurement)" is deleted.
