4-107. INSPECTION OF RECORDS.

THE GOVERNOR OR ANY MEMBER OF THE GENERAL ASSEMBLY MAY
INSPECT, DURING REGULAR BUSINESS HOURS, THE ACCOUNTS AND GENERAL
BOOKS OF THE COMPTROLLER.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second sentence of
former Art. 19, § 11.

The first sentence of former Art. 19, § 11, which
required the Comptroller to keep accounts, is retained
there and will be revised in the State Finance and
Procurement Article.

As to the duty of the Governor to inspect the accounts
and examine the Comptroller, under oath, see Md.
Constitution, Art. II, § 18.

TITLE 5. TREASURER.

5-101. POSITION.

THERE IS A TREASURER OF THE STATE, AS PROVIDED IN ARTICLE
VI, § 1 OF THE MARYLAND CONSTITUTION.

REVISOR'S NOTE: This section is new language added as a
general reference to the Constitutional provision that
creates the position of Treasurer.

As to the oath of office, see Art. 70, § 2 and Art.
95, § 1 of the Code.

5-102. SURETY BOND.

(A)  REQUIRED.

WHILE IN OFFICE, THE TREASURER SHALL BE COVERED BY A SURETY
BOND AS REQUIRED IN THIS SECTION.

(B)  FORM AND CONDITIONS.

THE SURETY BOND OF THE TREASURER SHALL:

(1)  RUN TO THE STATE;

(2)  BE IN THE AMOUNT THAT THE GOVERNOR APPROVES; AND

(3)  BE WITH A SURETY COMPANY THAT IS AUTHORIZED TO DO
BUSINESS IN THE STATE.

(C)  RENEWAL.

(1) IF THE GOVERNOR BELIEVES THAT THE SURETY BOND OF
THE TREASURER HAS OR IS LIKELY TO BECOME INVALID OR INSUFFICIENT,
