(B) STAFF.

SUBJECT TO THE REQUIREMENTS OF LAW AND ANY RULE OF THE
GENERAL ASSEMBLY, AN INVESTIGATING COMMITTEE MAY EMPLOY NECESSARY
STAFF FOR WHICH FUNDS ARE AVAILABLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 40, §§ 76,
77(b) and (c), and 78(c).

In subsection (a)(3) of this section, the former,
specific reference to a "majority ... of all the
members" is deleted as unnecessary in light of the
general reference to a "greater vote".

Also in subsection (a)(3) of this section, the former
reference to a meeting "at which there is a quorum" is
deleted as unnecessary in light of subsection (a)(2)
of this section.

In subsection (b) of this section, the word "staff" is
substituted for the former examples of types of staff.

Also in subsection (b) of this section, the former
reference to staff necessary "for the proper
performance of its duties" is deleted as unnecessary.

2-1607. SCOPE OF POWERS AND DUTIES.

(A)  SCOPE OF POWERS.

AN INVESTIGATING COMMITTEE MAY EXERCISE ITS POWERS:

(1)  WHEN THE GENERAL ASSEMBLY IS IN SESSION; AND

(2)  WHEN THE GENERAL ASSEMBLY IS NOT IN SESSION, IF
THE INVESTIGATING COMMITTEE IS AUTHORIZED TO DO SO:

(I)  BY LAW;

(II)  BY THE RESOLUTION THAT ESTABLISHES THE
INVESTIGATING COMMITTEE; OR

(III)  BY THE LAW OR RESOLUTION FROM WHICH THE
INVESTIGATING COMMITTEE DERIVES ITS INVESTIGATORY POWERS.

(B)  RULES.

(1) AN INVESTIGATING COMMITTEE SHALL ADOPT RULES THAT
GOVERN ITS PROCEDURES, INCLUDING THE CONDUCT OF HEARINGS.

(2) THE RULES MAY NOT BE INCONSISTENT WITH LAW OR ANY
APPLICABLE RULES OF THE GENERAL ASSEMBLY.
