PART II. ORGANIZATION AND GENERAL AUTHORITY OF DEPARTMENT.
2-1304. ESTABLISHED; AGENCY OF GENERAL ASSEMBLY.

(A)  ESTABLISHED.

THERE IS A DEPARTMENT OF LEGISLATIVE REFERENCE IN THE
LEGISLATIVE BRANCH OF THE STATE GOVERNMENT.

(B)  AGENCY OF GENERAL ASSEMBLY.

THE DEPARTMENT IS A STAFF AGENCY FOR THE GENERAL ASSEMBLY,
WITH THE POWERS AND DUTIES SET FORTH IN LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 40, § 49
and, except for the parenthetical clause, § 48.

In subsection (a) of this section, the reference to
the "Legislative Branch of the State government" is
substituted for the former, archaic reference to the
"Legislative Department", to standardize references to
the branches of the State government.

Former Art. 40, § 50(a), which created the Department
and referred generally to its powers, duties, and
employees, is deleted as surplusage.

2-1305. DIRECTOR.

(A)  POSITION AND APPOINTMENT.

THE HEAD OF THE DEPARTMENT IS THE DIRECTOR, WHO SHALL BE
APPOINTED JOINTLY BY THE PRESIDENT AND THE SPEAKER.

(B)  TENURE.

THE DIRECTOR SERVES WITHOUT A FIXED TERM AND MAY BE REMOVED
BY THE LEGISLATIVE POLICY COMMITTEE ON THE RECOMMENDATION OF THE
PRESIDENT AND THE SPEAKER.

(C)  SALARY.

THE DIRECTOR IS ENTITLED TO THE SALARY PROVIDED IN THE STATE
BUDGET.

REVISOR'S NOTE: Subsections (a) and (b) of this section are
new language derived without substantive change from
the first and fourth sentences and the first clause of
the third sentence of former Art. 40, § 50(b).
