(II) IF A VACANCY OCCURS AMONG THE DELEGATES ON
THE COMMITTEE, A SUCCESSOR PROMPTLY SHALL BE APPOINTED BY THE
SPEAKER.
(D) REMOVAL.
(1) THE COMMITTEE, BY RULE, SHALL ADOPT REQUIREMENTS
FOR FAITHFUL ATTENDANCE AND PERSEVERANCE OF ITS MEMBERS.
(2) THE FAILURE OF AN APPOINTED MEMBER TO COMPLY WITH
THOSE REQUIREMENTS SHALL BE REPORTED PROMPTLY TO THE PRESIDENT OR
THE SPEAKER, AS THE CASE MAY BE, WHO IMMEDIATELY SHALL REMOVE THE
MEMBER FROM THE COMMITTEE.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 40, §
55(a) through (c) and the first and second sentences
and the first clause of the third sentence of (e).
As to subsection (a) of this section and the terms
"Majority Leader" and "Minority Leader", see revisor's
note to § 2-403 of this title.
In subsection (c)(1) of this section, the reference to
serving "until the houses ... organize during the
following regular session" is added for clarity.
Subsection (d)(2) of this section is revised to
clarify that the President or the Speaker "remove" the
member and do not merely give notice of removal.
In subsection (d)(2) of this section, the word
"appointed" is added to modify "member". Although
former Art. 40, § 55(e) could be read to apply to the
entire membership, this reading seemed unlikely since
some members serve by virtue of holding other
positions. Thus, such a reading could suggest that
removal from this Committee entailed removal from the
other position.
The second clause of the third sentence of former Art.
40, § 55(e), which required prompt appointment of a
qualified successor for a member removed from the
Committee, is deleted as unnecessary in light of
subsection (c)(2) of this section.
