(2) To pay the costs of operating eMaryland Marketplace, the unit shall
deduct and retain from the procurement contract price that was submitted by the
responsible bidder to whom the procurement contract was awarded the fee specified
by the Department of Budget and Management under paragraph (3) of this
subsection.
(3) (i) The Department of Budget and Management shall establish by
regulation, and adjust each fiscal year as necessary, the fee that is to be deducted
from each procurement contract under this section.
(ii) The fee shall be set at an amount that is sufficient to pay the
costs of operating eMaryland Marketplace.]

[(h) (1) A unit may not charge a fee to access eMaryland Marketplace.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 514 - International Trade Agreement - Procurement Rules -
General Assembly Approval. I believe that the legislation exceeds the General
Assembly's constitutional power to the extent that it purports to invalidate the effect
of past legal actions of an executive branch official. Furthermore, this legislation
makes a mockery of the three distinct branches of government. The provisions of this
legislation also clearly encroach on executive branch prerogatives.
House Bill 514 prohibits the Governor, or any other State official, from binding the
State or giving consent to bind the State to the government procurement rules of an
