Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 838 - Public Safety Employees Killed in Performance of Duties -
Death Benefits - Heart Attack or Stroke.
This bill provides that a specified individual who dies from a heart attack or stroke
shall be presumed to have died in the performance of duties under specified
circumstances.
House Bill 1276, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 838.

AN ACT concerning
Public Safety Employees Killed in Performance of Duties - Death Benefits -
Heart Attack or Stroke
FOR the purpose of altering the amount of the death benefit for certain individuals
who are killed or die in the performance of duties; providing that an a certain
individual who dies from a heart attack or stroke shall be presumed to have died
in the performance of duties under certain circumstances; clarifying a certain
term; and generally relating to death benefits for employees killed in the
performance of duties.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Public Safety
1-202.
(a) (1) In this section the following words have the meanings indicated.
(2) (i) "Child" means a natural or adopted, legitimate or illegitimate
child or stepchild of the decedent.
(ii) "Child" includes a child or stepchild born posthumously.
