Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 793 — State Finance and Procurement - Funding for Public Art.
This bill establishes the Maryland Public Art Initiative Program and requires that
specified grantees provide and expend a matching fund prior to the award of specified
grants. The bill requires the Maryland State Arts Council to develop regulations to
implement the Maryland Public Art Initiative Program, establishes the Maryland
Commission on Public Art, specifies the membership of the Commission and
establishes the Maryland Public Art Fund.
House Bill 749, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 793.

AN ACT concerning
State Finance and Procurement - Capital Budget— Funding for Public Art
FOR the purpose of providing certain funds from the consolidated loan budget to be
used to fund certain activities of establishing the Maryland Public Art Initiative
Program; stating the intent of the General Assembly; requiring that certain
grantees provide and expend a matching fund prior to the award of certain
grants; requiring the Maryland State Arts Council to develop regulations to
implement the Maryland Public Art Initiative Program; establishing the
Maryland Commission on Public Art; specifying the membership of the
Commission; establishing the Maryland Public Art Fund; providing for the
purpose of the Fund; specifying that the Fund is a special, nonlapsing fund;
specifying that the State Treasurer shall hold the Fund separately and that the
Comptroller shall account for the Fund; specifying that certain proceeds shall be
invested and reinvested in a certain manner; specifying that certain earnings
shall be paid into the Fund, providing for the composition of the Fund; requiring
the Commission to administer the Fund; providing that money in the Fund may
only be used for certain purposes; providing for the termination of this Act;
requiring the Commission to make recommendations concerning disbursement
of the funds of the Maryland Public Art Initiative Program; and generally
relating to funding for public art.
