7-1006. (a) (1) The professional and supportive staff of a licensee who provides
residential or day habilitation services shall make a written plan of habilitation for
each individual with developmental disability who has been accepted for service by
the licensee. The plan shall meet applicable federal standards. (2)      At least once a year, the staff shall reevaluate the effectiveness and
adequacy of each plan in consultation with the individual with developmental
disability and any person authorized to act on behalf of the individual, and shall
revise the plan as needed. (3)      (I) THE REEVALUATION REQUIRED BY PARAGRAPH (2) OF THIS
SECTION SHALL INCLUDE A DETERMINATION OF WHETHER THE NEEDS OF THE
INDIVIDUAL COULD BE MET THROUGH LESS RESTRICTIVE SERVICES IN MORE
INTEGRATED SETTINGS. (II)     AT THE TIME OF THE REEVALUATION, EACH INDIVIDUAL WITH
A DEVELOPMENTAL DISABILITY SHALL BE PROVIDED A RANGE OF LESS RESTRICTIVE
THE MOST INTEGRATED SETTING SERVICE OPTIONS THAT MAY BE APPROPRIATE. (III)   THE INFORMATION PROVIDED UNDER SUBPARAGRAPH (II) OF
THIS PARAGRAPH SHALL BE GIVEN IN A MANNER APPROVED BY THE
ADMINISTRATION. (4)      At least once a year, the Administration shall review the licensee's
execution of the plan of habilitation, and compliance with the rules, regulations, and
standards which the Secretary adopts. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2005.

Annapolis, MD 21401 Dear Mr. President: In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 786 - Hurricane Isabel Disaster Relief Act - Reporting
Requirements - Financial Assistance Applications - Extension of Termination.
This emergency bill extends until September 30, 2006 the date on or before which the
Department of Housing and Community Development shall issue to the General
Assembly a final report on the implementation of the Hurricane Isabel Disaster Relief
Act. The bill also extends through May 31, 2006 the date on which Section 1 of the
Hurricane Isabel Disaster Relief Act shall be terminated, and provides for deadlines
for applications for financial assistance under the Hurricane Isabel Disaster Relief
Act until September 30, 2005.
