S.B. 759 VETOES
Fund Program" of Article 41 - Governor - Executive and Administrative Departments
of the Annotated Code of Maryland be transferred to be Section(s) 7-1201 through
7-1207, respectively, and the subtitle "Subtitle 12. Maryland After-School
Opportunity Fund Program" of Article - Education of the Annotated Code of
Maryland.
SECTION 5. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

(J) THE STATE SUPERINTENDENT SHALL ESTABLISH AN EARLY CHILDHOOD
DEVELOPMENT DIVISION WITHIN THE DEPARTMENT.

5-550.
(A) IN PART V OF THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(B) "DEPARTMENT" MEANS THE STATE DEPARTMENT OF EDUCATION.
(C) "DIRECT GRANT FUND" MEANS THE FAMILY DAY CARE PROVIDER DIRECT
GRANT FUND.
(D) "FAMILY DAY CARE PROVIDER" MEANS AN INDIVIDUAL WHO CARES FOR
NO MORE THAN EIGHT CHILDREN IN A REGISTERED FAMILY DAY CARE HOME.
(E) "STATE SUPERINTENDENT" MEANS THE STATE SUPERINTENDENT OF
SCHOOLS.

(a) The Department shall implement a system of registration for family day
care homes.
(b) The purpose of registration of family day care homes is to:
(1) protect the health, safety, and welfare of children while they are in
family day care;
(2) identify family day care homes;
(3) provide basic technical assistance and child care information to day
care providers; and
(4) minimize the regulatory rigidity often associated with licensing.
(c) The system of registration is intended to promote a high degree of
flexibility in the regulation of family day care homes while assuring the health and
safety of children who are cared for in family day care homes.
