CHAPTER 459
(Senate Bill 92)
AN ACT concerning
Proposed Capital Projects - Planning - High Performance Buildings
FOR the purpose of requiring a unit of State government requesting an appropriation
for the preliminary planning of a proposed capital project to include in its
program submission to the Department of Budget and Management a
justification for proposing that the building is not appropriate for design as a
high performance building; requiring the Department to conduct a certain review
if a certain justification is submitted; defining a certain term; and generally
relating to the planning and design of high performance buildings in proposed
capital projects.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

3-602.
(d) (1) (I) IN THIS SUBSECTION PARAGRAPH, "HIGH PERFORMANCE
BUILDING" MEANS A BUILDING THAT ACHIEVES AT LEAST:
(I) 1. ACHIEVES AT LEAST A SILVER RATING ACCORDING TO
THE U.S. GREEN BUILDING COUNCIL'S LEED (LEADERSHIP IN ENERGY AND
ENVIRONMENTAL DESIGN) GREEN BUILDING RATING SYSTEM AS ADOPTED IN 2001
OR SUBSEQUENTLY BY THE MARYLAND GREEN BUILDING COUNCIL; OR
(II) 2. ACHIEVES AT LEAST A TWO GLOBE RATING ACCORDING
TO THE GREEN GLOBES PROGRAM AS ADOPTED BY THE GREEN BUILDING
INITIATIVE; OR
(II) (III) 3. ACHIEVES AT LEAST A COMPARABLE NUMERIC
RATING ACCORDING TO A NATIONALLY RECOGNIZED, ACCEPTED, AND APPROPRIATE
NUMERIC SUSTAINABLE DEVELOPMENT RATING SYSTEM, GUIDELINE, OR
STANDARD; OR
