(2) AS SOON AS IS PRACTICABLE AFTER THE PROPONENT OF THE
STATEMENT LEARNS THAT THE DECLARANT WILL BE UNAVAILABLE, THE
PROPONENT NOTIFIES THE ADVERSE PARTY OF:
(I) THE INTENTION TO OFFER THE STATEMENT;
(II) THE PARTICULARS OF THE STATEMENT; AND
(III) THE IDENTITY OF THE WITNESS THROUGH WHOM THE
STATEMENT WILL BE OFFERED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2005.

AN ACT concerning
Criminal Procedure - Criminal Justice Information Advisory Board -
Membership and Duties
FOR the purpose of establishing a new termination date for the Commission on Public
Safety Technology and Critical Infrastructure and transferring certain members
and duties of the Commission to the Criminal Justice Information Advisory
Board; adding members to the Criminal Justice Information Advisory Board;
requiring the Board to make certain recommendations and to consult and
cooperate with certain governmental units; requiring the Board to submit an
annual report on or before a certain date to the Governor and the General
Assembly; and generally relating to the Criminal Justice Information Advisory
Board.
BY repealing and reenacting, with amendments,
Chapter 277 of the Acts of the General Assembly of 2002
