(7) Penalties assessed under this subsection shall be paid into the
General Fund of the State.
SECTION 2. AND BE IT FURTHER ENACTED, That the effective date for the
implementation of efficiency standards for unit heaters and commercial refrigeration
cabinets set forth in COMAR 14.26.03.06A shall be 90 days after the effective date of
this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That the labeling
requirements set forth in COMAR 14.26.03.10 may not take effect until March 1,
2006.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 2005.

AN ACT concerning
Nursing Facility Conversion Grant Program
FOR the purpose of establishing the Nursing Facility Conversion Grant Program;
authorizing the Board of Public Works, on the recommendation of the Secretary
of Health and Mental Hygiene to provide grants under the Program to counties,
municipal corporations, and nonprofit organizations for the conversion of
nursing facility beds to certain other health care services; requiring the
Department of Health and Mental Hygiene to make certain recommendations;
authorizing the Board of Public Works to adopt certain regulations; providing
certain terms, conditions, and limitations on the allocations, use, and amount of
State grants under the Program; providing that no proceeds of a grant may be
used for certain religious purposes; providing that, under certain circumstances,
the State may recover a certain portion of the State funds expended; providing
for certain judicial proceedings and liens to enforce the State's right of recovery
and the priority of the proceedings and liens; providing that temporary
delicensure of bed capacities of certain facilities do not require certificate of need
review under certain circumstances; providing that the Maryland Health Care
Commission shall retain certain bed capacities on its inventory under certain
circumstances; requiring the Department of Health and Mental Hygiene to
adopt certain regulations in consultation with the Maryland Health Care
Commission and the nursing home industry; defining certain terms; and
generally relating to grants for the conversion of nursing facilities.
