REPORTS, OR REPORTS AND REPORTS FILED UNDER AN ANIMAL HEALTH PROGRAM
ESTABLISHED BY THE SECRETARY, IN A MANNER THAT PROTECTS THE IDENTITY OF
THE ANIMAL OWNER
(2) (I) THIS SUBSECTION DOES NOT APPLY TO A DISCLOSURE BY IF
THE SECRETARY DETERMINES THAT THE DISCLOSURE IS NECESSARY TO PROTECT
THE PUBLIC HEALTH OR PREVENT THE SPREAD OF AN INFECTIOUS OR CONTAGIOUS
DISEASE, THE SECRETARY MAY DISCLOSE THE IDENTITY OF AN ANIMAL OWNER TO A
PERSON IN INTEREST, AS DEFINED BY THE SECRETARY, OR TO A GOVERNMENTAL
AGENCY PERFORMING ITS LAWFUL DUTIES IDENTIFYING INFORMATION.
(II) IN DETERMINING WHETHER DISCLOSURE IS NECESSARY TO
PROTECT THE PUBLIC HEALTH OR PREVENT THE SPREAD OF AN INFECTIOUS OR
CONTAGIOUS DISEASE, THE SECRETARY SHALL CONSULT WITH THE SECRETARY OF
HEALTH AND MENTAL HYGIENE WHERE THE SECRETARY DETERMINES THAT THE
DISCLOSURE IS NECESSARY TO PROTECT THE PUBLIC HEALTH OR TO PREVENT THE
SPREAD OF AN INFECTIOUS OR CONTAGIOUS DISEASE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2005.

(House Bill 163)
AN ACT concerning
Child Care Centers and Family Day Care Homes - Employees - Background
Checks
FOR the purpose of authorizing the Child Care Administration of the Department of
Human Resources to disclose to the operator of a child care center or to a family
day care provider reports and records concerning child abuse and neglect for a
certain purpose; requiring the Department of Public Safety and Correctional
Services to provide an initial and a revised statement of a certain applicant's
State criminal record to the Child Care Administration; requiring the
Department of Public Safety and Correctional Services to submit a certain
printed statement concerning a certain employee to the Child Care
Administration; specifying that certain requirements of this Act apply only to
certain employees; requiring that each employee of a child care center apply to
the Child Care Administration, on or before a certain date, for a child abuse and
neglect clearance; authorizing the Child Care Administration to prohibit the
operator of a child care center from employing a certain individual; requiring
the operator of a child care center to immediately notify the Child Care
Administration of a certain criminal history records check of an employee; and
generally relating to child care centers and family day care homes.
