(House Bill 71)
AN ACT concerning
Department of Agriculture - Weights and Measures - Fees
FOR the purpose of altering certain registration fees for certain weights and
measures; establishing a certain registration fee for a certain weights and
measures device; repealing obsolete provisions of law; providing that unspent
portions of the Weights and Measures Fund up to a certain maximum sum
remain with the Fund and not be transferred or revert to the State General
Fund; and generally relating to weights and measures registration fees and the
Weights and Measures Fund.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article -Agriculture
11-204.6.
(a) (1) There is a "Weights and Measures Fund".
(2) All fees collected under §§ 11-204.3, 11-201.1, and 11-204.7 of this
subtitle shall be credited to the Fund.
(3) The Fund shall be used to defray the expenses of administering this
title.
(b) [The Fund shall be used for the purposes stated in this title and unspent
portions of the Fund shall revert to the General Fund of the State.]
NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY UNSPENT PORTIONS OF
THE FUND, UP TO A MAXIMUM OF $100,000, MAY NOT BE TRANSFERRED OR REVERT
TO THE GENERAL FUND OF THE STATE, BUT SHALL REMAIN IN THE FUND TO BE
USED FOR THE PURPOSES STATED IN THIS TITLE.

(1) Scales with a capacity of up to 100 pounds (maximum fee per
