(4) GIVE THE PATIENT OR PERSON RESPONSIBLE FOR PROVIDING
CONTINUING CARE TO THE PATIENT WRITTEN DISCHARGE INSTRUCTIONS IN A
FORM THE PATIENT CAN UNDERSTAND; AND
(5) HELP TO ENSURE THAT CONTINUITY OF CARE, TREATMENT, AND
SERVICES IS MAINTAINED.
(C) (D) IF A HOSPITAL FAILS TO COMPLY WITH THE REQUIREMENTS OF
THIS SECTION, THE SECRETARY MAY IMPOSE A CIVIL MONEY PENALTY NOT TO
EXCEED $10,000 FOR EACH VIOLATION OF THIS SECTION FAILURE TO COMPLY.
(D) (E) A HOSPITAL OR RELATED INSTITUTION MAY APPEAL A CIVIL
MONEY PENALTY IMPOSED UNDER SUBSECTION (B) (C) OF THIS SECTION IN
ACCORDANCE WITH TITLE 10, SUBTITLE 2 OF THE STATE GOVERNMENT ARTICLE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2005.

(Senate Bill 304)
AN ACT concerning
Health Occupations - Podiatrists - Scope of Practice
FOR the purpose of allowing certain surgical procedures performed by licensed
podiatrists to be performed in a licensed ambulatory surgical center under
certain circumstances; requiring a licensed podiatrist who performs certain
surgical procedures in a licensed ambulatory surgical center to have certain
surgical privileges at a licensed hospital and meet certain requirements;
allowing a licensed ambulatory surgical center to establish qualifications or
delineate privileges for the performance of certain surgical procedures by a
licensed podiatrist; altering the definition of "practice podiatry"; and generally
relating to the practice of podiatry.
