Ch. 280                                        2005 LAWS OF MARYLAND 1. $500,000 IN FISCAL YEAR 2006; AND 2. $1,700,000 IN FISCAL YEAR 2007 AND ANNUALLY
THEREAFTER
(3) FOR ANY YEAR THE SUBSIDY AND FUNDING REQUIRED UNDER THIS
SUBSECTION BY A NONPROFIT HEALTH SERVICE PLAN SUBJECT TO THIS SECTION
MAY NOT EXCEED THE VALUE OF THE NONPROFIT HEALTH SERVICE PLAN'S
PREMIUM TAX EXEMPTION UNDER § 6-101(B) OF THIS ARTICLE.
(e) The subsidy required under the Senior Prescription Drug Program may
not exceed the value of the nonprofit health service plan's premium tax exemption
under § 6-101(b) of this article.
(f) (1) Subject to paragraph (2) of this subsection, each report filed with the
Commissioner under subsection (b) of this section is a public record.
(2) In accordance with § 10-617(d) of the State Government Article, the
Commissioner shall deny inspection of any part of a report filed under subsection (b)
of this section that the Commissioner determines contains confidential commercial
information or confidential financial information.
14-106.1. (A) BEGINNING IN FISCAL YEAR 2006, A NONPROFIT HEALTH SERVICE PLAN
SHALL TRANSFER FUNDS TO THE COMMUNITY HEALTH RESOURCES COMMISSION
FUND ESTABLISHED UNDER § 19-2112 OF THE HEALTH GENERAL ARTICLE FOR THE
PURPOSE OF PROVIDING:
(1) $10,000,000 AN AMOUNT EQUAL TO THE VALUE OF THE NONPROFIT
HEALTH SERVICE PLAN'S PREMIUM TAX EXEMPTION UNDER § 6-101(B) OF THIS
ARTICLE, LESS THE AMOUNT NEEDED TO SUBSIDIZE THE SENIOR PRESCRIPTION
DRUG PROGRAM ESTABLISHED UNDER SUBTITLE 5, PART II OF THIS TITLE IN
ANNUAL OPERATING GRANTS TO COMMUNITY HEALTH RESOURCES; AND
(2) $5,000,000 IN ANNUAL SUPPORT FOR PROJECTS RECOMMENDED BY
THE COMMITTEE ON DATA INFORMATION SYSTEMS ESTABLISHED UNDER § 19-2111
OF THE HEALTH GENERAL ARTICLE.
BEGINNING IN FISCAL YEAR 2006, A NONPROFIT HEALTH SERVICE PLAN SHALL
TRANSFER FUNDS IN THE AMOUNTS PROVIDED UNDER § 14-106(D)(2) OF THIS
SUBTITLE TO:
(1) THE COMMUNITY HEALTH RESOURCES COMMISSION FUND
ESTABLISHED UNDER § 19-2201 OF THE HEALTH - GENERAL ARTICLE TO SUPPORT
THE COSTS OF THE COMMUNITY HEALTH RESOURCES COMMISSION AS PROVIDED IN
§ 14-106(D)(1)(V) OF THIS SUBTITLE; AND
(2) THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE TO
SUBSIDIZE THE MARYLAND PHARMACY DISCOUNT PROGRAM UNDER § 15-124 OF THE
HEALTH - GENERAL ARTICLE.
