(c) A person may not knowingly employ any individual who is not authorized
to perform delegated nursing duties under this subtitle.
(D) A PERSON MAY NOT KNOWINGLY EMPLOY TO PRACTICE AS A CERTIFIED
NURSING ASSISTANT ANY PERSON WHO IS NOT AUTHORIZED TO PRACTICE AS A
CERTIFIED NURSING ASSISTANT UNDER THIS TITLE.
(E) A PERSON MAY NOT KNOWINGLY EMPLOY TO PRACTICE AS A CERTIFIED
MEDICATION TECHNICIAN ANY PERSON WHO IS NOT AUTHORIZED TO PRACTICE AS A
CERTIFIED MEDICATION TECHNICIAN UNDER THIS TITLE.
(F) A PERSON MAY NOT KNOWINGLY EMPLOY TO PRACTICE AS A CERTIFIED
MEDICINE AIDE ANY PERSON WHO IS NOT AUTHORIZED TO PRACTICE AS A
CERTIFIED MEDICINE AIDE UNDER THIS TITLE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2005 is an emergency measure, is necessary for the immediate
preservation of the public health or safety, has been passed by a yea and nay vote
supported by three-fifths of all of the members elected to each of the two Houses of
the General Assembly, and shall take effect from the date it is enacted.

(House Bill 402)
AN ACT concerning
Commercial Fertilizer - Ammonium Nitrate - Identification for Sale or
Distribution Information
FOR the purpose of requiring a distributor of ammonium nitrate to maintain, for a
certain period of time, a record of certain information of sale or distribution
information; authorizing a distributor to refuse to sell or distribute ammonium
nitrate in under certain circumstances; requiring a distributor to report make
available certain information to the Secretary of Agriculture at certain times
upon a certain request; prohibiting the Secretary from registering certain
distributors requiring the Secretary of Agriculture to maintain certain records
in a certain manner except under certain circumstances; requiring the
Secretary, in consultation with the Office of Homeland Security, to adopt certain
regulations; and generally relating to the sale or distribution of ammonium
nitrate.
