(2) "HOUSING PROJECT" INCLUDES LANDS, BUILDINGS,
IMPROVEMENTS, AND OTHER REAL OR PERSONAL PROPERTY.
REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 44A, § 3-102(e), the second sentence
of (j), and the third sentence of § 3-103(c).
In paragraph (1) of this subsection, the former reference to "any
undertaking or project, or portion thereof," is deleted as surplusage.
In paragraph (1)(i) of this subsection, the reference to "housing" is
substituted for the former reference to "dwelling accommodations" to
conform to the terminology used throughout this article.
In paragraph (2)(i) of this subsection, the former reference to
"mixed ... properties, or interest therein" is deleted as included in the
reference to "real or personal" property.
Also in paragraph (2)(i) of this subsection, the reference to property that is
"used" is added for clarity.
(D) PERSON OF ELIGIBLE INCOME.
"PERSON OF ELIGIBLE INCOME" MEANS AN INDIVIDUAL OR A FAMILY THAT
LACKS SUFFICIENT INCOME OR ASSETS WITHOUT FINANCIAL ASSISTANCE TO LIVE
IN DECENT, SAFE, AND SANITARY HOUSING WITHOUT OVERCROWDING.
REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 44A, § 3-102(f) and the second
sentence of § 3-103(c).
The former phrase "as applied to the Housing Authority of Baltimore City"
is deleted as surplusage.
The former phrase "(as determined by the Mayor of Baltimore City or his
designee)" is deleted as unnecessary in light of § 12-106 of this article.
The reference to "housing" is substituted for the former reference to
"dwellings" to conform to the terminology used throughout this article.
GENERAL REVISOR'S NOTE TO SECTION:
Former Art. 44A, § 3-102(g), which defined the terms "resolution" and
"ordinance" to refer when applicable to an ordinance of the Mayor and City Council of
Baltimore, is deleted as unnecessary because the phrase "resolution or ordinance of
the legislative body", which clearly encompasses an ordinance of the Mayor and City
Council of Baltimore, is used throughout this Division II. See, e.g., § 12-202 of this
article.
15-102. APPLICABILITY OF TITLE 12.
TITLE 12 OF THIS ARTICLE APPLIES TO THE BALTIMORE AUTHORITY EXCEPT
WHERE IT IS INCONSISTENT WITH THIS TITLE.
