(2) SUBJECT TO APPROVAL BY THE MAYOR OF ANNAPOLIS AND BY THE
UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, THE
PROHIBITION CONTAINED IN PARAGRAPH (1) OF THIS SUBSECTION MAY BE WAIVED
FOR GOOD CAUSE SHOWN. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 44A, § 10-102(b). In subsection (a)(1) of this section, the former reference to the
Commissioners "exercising the powers and duties set forth in this [Division

Annapolis Authority property "other than an Annapolis Authority property
for seniors" is added for clarity. In subsection (b)(2) of this section, the reference to terms being staggered
as required by the terms provided for Commissioners on "October 1, 2006"
is substituted for the former obsolete reference to terms being staggered as
required by the terms provided on "July 1, 2002". This substitution is not
intended to alter the term of any member of the Commission. See § 3 of Ch.
63, Acts of 2006. The terms of the members serving on October 1, 2006, end
as follows: (1) three Commissioners on July 31, 2007; (2) one Commissioner
on July 31, 2008; (3) one Commissioner on July 31, 2009; and (4) two
Commissioners on July 31, 2011. Defined terms: "Annapolis Authority" § 13-101
"Commissioner" § 13-101 13-105. STATUS OF COMMISSIONERS AND ANNAPOLIS AUTHORITY PERSONNEL. (A)     COMMISSIONERS AND PERSONNEL AS LOCAL OFFICIALS. NOTWITHSTANDING ANY OTHER LAW, THE ANNAPOLIS AUTHORITY'S
COMMISSIONERS, EXECUTIVE DIRECTOR, AND DEPUTY DIRECTORS ARE LOCAL
OFFICIALS UNDER ANY PUBLIC ETHICS LAW OF THE ANNAPOLIS CITY COUNCIL. (B)     DISCLOSURE OF CONFLICTS OF INTEREST. (1)      WHEN FIRST RETAINED BY THE ANNAPOLIS AUTHORITY, ATTORNEYS
AND CONSULTANTS SHALL DISCLOSE POTENTIAL CONFLICTS OF INTEREST
RELATING TO REPRESENTATION OF THE ANNAPOLIS AUTHORITY. (2)      THE ANNAPOLIS AUTHORITY SHALL ADOPT REGULATIONS TO CARRY
OUT THIS SUBSECTION. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 44A, § 10-102(j). In subsection (a) of this section, the former reference to "the City of
Annapolis" is deleted as surplusage.
