12-202. ENABLING LEGISLATION.
SECTIONS 12-203 THROUGH 12-206 OF THIS SUBTITLE ARE ONLY ENABLING
LEGISLATION ALLOWING A POLITICAL SUBDIVISION TO AUTHORIZE AN AUTHORITY
TO OPERATE IN THE POLITICAL SUBDIVISION.
REVISOR'S NOTE: This section is new language derived without substantive
change from the second sentence of former Art. 44A, § 1-501(e).
The defined term "political subdivision" is substituted for the former
reference to "local jurisdictio[n]" to conform to the terminology used
throughout this article.

12-203. CODE AUTHORITIES.
A CODE AUTHORITY MAY NOT DO BUSINESS OR EXERCISE ITS POWERS UNLESS:
(1) ITS ARTICLES OF ORGANIZATION HAVE BEEN RECOMMENDED IN
WRITING BY THE CHIEF ELECTED OFFICIAL, ADOPTED BY A RESOLUTION OR
ORDINANCE OF THE LEGISLATIVE BODY, AND FILED WITH THE SECRETARY OP
STATE; AND
(2) THE SECRETARY OF STATE HAS ISSUED A CERTIFICATE OF
ORGANIZATION TO THE CODE AUTHORITY.
REVISOR'S NOTE: This section is new language derived without substantive
change from the second clause of the introductory language of former Art.
44A, § 1-203(a) through (a)(3).
In the introductory language of this section, the defined term "code
authority" is substituted for the former reference to "any authority not
activated prior to July 1, 1990" for brevity and to conform to the
terminology used throughout this Division II.
In item (1) of this section, the former phrase "in accordance with this
section" is deleted as surplusage.
