21-2A-09. (A)     A DISPENSER WHO KNOWINGLY FAILS TO SUBMIT PRESCRIPTION
MONITORING DATA TO THE PROGRAM AS REQUIRED UNDER THIS SUBTITLE SHALL
BE SUBJECT TO A CIVIL PENALTY NOT EXCEEDING $500 FOR EACH FAILURE TO
SUBMIT REQUIRED INFORMATION. (B)     AN AUTHORIZED RECIPIENT WHO KNOWINGLY DISCLOSES OR USES
PRESCRIPTION MONITORING DATA IN VIOLATION OF THIS SUBTITLE SHALL BE
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT
NOT EXCEEDING 1 YEAR OR A FINE NOT EXCEEDING $10,000 OR BOTH. SECTION 2. AND BE IT FURTHER ENACTED, That implementation of the
Prescription Drug Monitoring Program to be established under § 21-2A-02 of the
Health - General Article, as enacted by Section 1 of this Act, is contingent on the
Advisory Board on Prescription Drug Monitoring established under § 21-2A-03 of the
Health - General Article, as enacted by Section 1 of this Act, obtaining federal,
private, or State funds to carry out the purposes of this Act. SECTION 3. AND BE IT FURTHER ENACTED, That the Prescription Drug
Monitoring Program to be established under § 21-2A-02 of the Health - General
Article, as enacted by Section 1 of this Act, may not collect prescription monitoring
data before June 1, 2007. SECTION 2. 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2006.

Annapolis, MD 21401 Dear Mr. Speaker: In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 1309 - Baltimore Corridor Transit Study - Red Line - Requirements
and Citizens' Advisory Council.
House Bill 1309 would establish a Citizens' Advisory Council for the Baltimore
Corridor Transit Study of the Red Line. This Council would inform the Maryland
Transit Administration of the Council's views on location, funding, and benefits of the
Red Line, among other items related to the Red Line's impact on the citizens of
Baltimore and the surrounding areas. The Red Line is one of the State's top
transportation priorities for the Baltimore Metropolitan area. My Administration has
already invested $11.4 million to advance this important project. House Bill 1309 is not necessary. It is redundant to my Executive Order
01.01.2006.04, which provides for a Community Advisory Council to address concerns
about the future development of the Red Line in Baltimore. The Maryland
Department of Transportation currently receives input from citizens affected by the - 3830 -
