H.B. 1041                                               VETOES
Dear Mr. Speaker: In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 1041 - Mercury-Added Products - Prohibition of Sale of
Thermostats and Report.
This bill prohibits a specified marketer from selling or providing a thermostat
containing mercury to a consumer; requires the Department of the Environment to
make a specified report to the Governor and specified legislative committees on or
before October 1, 2007, relating to the statewide collection, reclamation, and recycling
of all products containing mercury; and requires the Secretary of the Environment to
convene and consult with a specified advisory group in preparing the report. Senate Bill 772, which was passed by the General Assembly and allowed to go into
effect without my signature, accomplishes the same purpose. Therefore, it is not
necessary for me to sign House Bill 1041. Very truly yours,

Governor House Bill No. 1041 AN ACT concerning Mercury-Added Products - Prohibition of Sale of Thermostats and Report FOR the purpose of prohibiting a certain marketer from selling or providing a
thermostat containing mercury to a consumer; requiring the Department of the
Environment to make a certain report to the Governor and certain legislative
committees on or before a certain date, relating to the Statewide collection,
reclamation, and recycling of all products containing mercury; requiring the
Secretary of the Environment to convene and consult with a certain advisory
group in preparing a certain report; providing that a certain lobbyist is not
subject to certain provisions of law if the lobbyist is appointed to serve on a
certain advisory group; defining a certain term; altering a certain definition;
providing for a delayed effective date for certain provisions of this Act; and
generally relating to mercury-added products. BY renumbering Article — Environment Section 6-905.2 to be Section 6-905.3 Annotated Code of Maryland (1996 Replacement Volume and 2005 Supplement) BY repealing and reenacting, with amendments,
