H.B. 128 VETOES
invade the authority granted exclusively to Baltimore City in its Charter in an effort
to regulate an aspect of the land development process in Baltimore City. The Attorney
General concludes in his bill review letter that House Bill 128 violates Maryland
Constitution Article XI-A, Section 4. For the above reason, I have vetoed House Bill 128. Very truly yours,

AN ACT concerning
Baltimore City Charter Amendment - Housing - Proposed Development -
Notice to Community Association FOR the purpose of adding a new section to Article II of the Charter of Baltimore City,
to require a housing developer or builder to fulfill certain requirements before a
permit for the rehabilitation, replacement, or construction of a housing
development of a certain size in a certain area may be issued; requiring that the
developer or builder consult with a certain community association and agree to
reserve a minimum number of housing units as affordable housing for families
or individuals who meet certain income eligibility standards; requiring the
Department of Planning to adopt certain regulations;
requiring a developer,
before obtaining a permit from Baltimore City for the construction of a certain
development located in Baltimore City within the boundaries of a community
represented by a community association, to notify the community association
and meet with its members at a scheduled meeting concerning the proposed
development; defining a certain term; and generally relating to housing in
Baltimore City. BY adding to The Charter of Baltimore City Article IIGeneral Powers Section (15B) (1996 Edition and 2000 Supplement, as amended) BY repealing and reenacting, without amendments,
