S.B. 392                                                  VETOES SECTION 2. AND BE IT FURTHER ENACTED. That on or before September
30, 2007, and annually thereafter through September 30, 2009, inclusive, the
Procurement Advisor appointed by the Board of Public Works shall report to the
Governor, and, in accordance with § 2-1246 of the State Government Article, to the
Senate Education, Health, and Environmental Affairs Committee and House Health
and Government Operations Committee, regarding the implementation of this Act
during the immediately preceding fiscal year, including the impact of this Act on
small business and minority business enterprises, SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall be
construed to apply only prospectively and may not be applied or interpreted to have
any effect on or application to any requirement for bid security or for payment
security or performance security due before the effective date of this Act. SECTION 2. 4. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2006. It shall remain effective for a period of 3 years and, at the end
of September 30, 2009, with no further action required by the General Assembly, this
Act shall be abrogated and of no further force and effect.

Annapolis, MD 21401 Dear Mr. President: In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 392 - Education - Blind and Visually Impaired Students -
Instructional Materials.
This bill requires the State Department of Education to collaborate with and provide
support to the Instructional Resources Center to develop procedures to coordinate the
statewide availability of textbooks and supplementary instructional materials that
may be accessed using specified specialized formats using the federal National
Instructional Materials Accessibility Standard. Senate Bill 392 also requires the
Department and county boards of education to include a specified provision in
textbook and instructional materials procurement contracts. House Bill 710, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 392. Very truly yours,
