S.B. 386 VETOES
(I)      PROVIDES EVIDENCE TO THE DEPARTMENT THAT THE
REQUIREMENTS OF THIS SECTION WILL CREATE AN UNDUE FINANCIAL BURDEN ON
THE FACILITY AND WILL REQUIRE THE FACILITY TO CEASE OPERATION; AND (II)     DISCLOSES TO THE RESIDENTS OF THE FACILITY THAT THE
FACILITY DOES NOT HAVE AN EMERGENCY ELECTRICAL POWER GENERATOR THAT
MEETS THE REQUIREMENTS OF THIS SECTION. (2)      THE DEPARTMENT SHALL EVALUATE SUBJECT TO PARAGRAPH (3) OF
THIS SUBSECTION, A WAIVER GRANTED UNDER PARAGRAPH (1) OF THIS SUBSECTION
EACH YEAR MAY NOT EXCEED A PERIOD OF 3 YEARS. (3)      THE DEPARTMENT MAY EXTEND A WAIVER GRANTED UNDER
PARAGRAPH (1) OF THIS SUBSECTION FOR AN ADDITIONAL PERIOD OF 2 YEARS
BEYOND THE PERIOD SPECIFIED IN PARAGRAPH (2) OF THIS SUBSECTION. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2009.

Annapolis, MD 21401 Dear Mr. President: In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 386 -Charles County - Salary of State's Attorney. This bill alters the mandated salary of the State's Attorney in Charles County to
conform to, the salary of a State circuit court judge; and provides that the Act does not
apply to the State's Attorney for Charles County in office on October 1, 2006. House Bill 611, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 386. Very truly yours,
