ROBERT L. EHRLICH, JR., Governor                            S.B. 323 structure the benefit subsidy under the Senior Prescription Drug Assistance Program
to cover any out-of-pocket costs an enrollee in the Program may incur for
prescription drugs. SECTION 4. AND BE IT FURTHER ENACTED, That the Maryland Health
Insurance Plan may not spend any remaining funds from the Senior Prescription
Drug Program that may accrue to the account of the Senior Prescription Drug
Assistance Program without the approval of the General Assembly. SECTION 2. 5. AND BE IT FURTHER ENACTED, That this Act shall apply
to individuals enrolled in the Senior Prescription Drug Assistance Program beginning
January 1, 2006. SECTION 3. 6. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health
or safety, has been passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two Houses of the General Assembly, and shall take
effect from the date it is enacted.

vetoed Senate Bill 323 - Maryland Food Center Authority - Technical Changes. This bill clarifies that the Governor may appoint eight members to the Maryland
Food Center Authority; authorizes ex officio Authority members to name designees;
repeals specified provisions of law establishing an advisory council to the Authority;
and provides for the issuance of federally taxable or tax-exempt bonds authorizing
the use of specified revenues for the operation, improvement, maintenance, and
protection of developments or projects. House Bill 881, which was passed by the General Assembly and allowed to go into
effect without my signature, accomplishes the same purpose. Therefore, it is not
necessary for me to sign Senate Bill 323. Very truly yours,
