(b) For purposes of subsection (a) of this section, assisting in the drafting of
specifications, an invitation for bids, or a request for proposals for a procurement does
not include:
(4) providing architectural and engineering services for:
(ii) the design of a construction project if:
2. the design services do not involve lead or prime design
responsibilities [on] OR construction phase responsibilities on behalf of the State; or

(c) (3) A subpoena issued under [subsection (b) of this section] PARAGRAPH
(1) OF THIS SUBSECTION shall be served:
(i) in the manner provided by law for service of a subpoena in a
civil action;
(ii) before the time that the subpoena sets for appearance or
production of records; and
(iii) with the following documents:
1. a copy of this title;
2. a copy of the rules of the Joint Ethics Committee; and
3. if the subpoena requires the appearance of a person, notice
that counsel may accompany the person.
