(4) The retiree's allowance will be reinstated on the first day of the
month following the month in which the retiree ceased employment with the
participating employer.
(c) A member who retires on or after July 1, 1982, and receives a disability
retirement allowance shall provide yearly medical and earnings information on
request of the Board of Trustees until the retiree attains normal retirement age.
(d) If the retiree refuses to provide the information, the Board of Trustees
shall suspend the retiree's allowance until the information is provided.
(E) THE BOARD OF TRUSTEES SHALL, AFTER GIVING NOTICE, TEMPORARILY
SUSPEND THE RETIREMENT ALLOWANCE OF A RETIREE UNDER SUBSECTION (B) OF
THIS SECTION IF THE RETIREE IS REEMPLOYED IN ANY POSITION OTHER THAN A
PROBATIONARY STATUS LAW ENFORCEMENT OFFICER, A LAW ENFORCEMENT
OFFICER, OR CHIEF, AS DEFINED IN § 3-101 OF THE PUBLIC SAFETY ARTICLE.
29-116.
(a) [This] EXCEPT AS PROVIDED IN SUBSECTION (E) OF THIS SECTION, THIS
section does not apply to a retiree of: WHO IS:
(I) (1) A RETIREE OF:
1. (I) THE STATE POLICE RETIREMENT SYSTEM:
2. (II) THE LAW ENFORCEMENT OFFICERS' PENSION
SYSTEM:
3. (III) THE LOCAL FIRE AND POLICE SYSTEM: OR
4. (IV) THE EMPLOYEES' RETIREMENT SYSTEM OR THE
EMPLOYEES' PENSION SYSTEM, IF AT THE TIME OF RETIREMENT THE RETIREE WAS A
LAW ENFORCEMENT OFFICER FOR A PARTICIPATING EMPLOYER UNDER § 26-20(A)
OF THIS ARTICLE: AND
(II) (2) REEMPLOYED BY A PARTICIPATING EMPLOYER IN ANY
POSITION OTHER THAN A PROBATIONARY STATUS LAW ENFORCEMENT OFFICER A
LAW ENFORCEMENT OFFICER OR CHIEF, AS DEFINED IN § 3-101 OF THE PUBLIC
SAFETY ARTICLE.
(1) the State Police Retirement System [or], the Law Enforcement
Officers' Pension System, OR THE LOCAL FIRE AND POLICE SYSTEM who is receiving
an ordinary disability retirement allowance [if the retiree is reemployed in any
position other than a probationary statue law enforcement officer, a law enforcement
officer, or chief, as defined in § 3-101 of the Public Safety Article]; OR
(2) THE EMPLOYEES' RETIREMENT SYSTEM OR THE EMPLOYEES'
PENSION SYSTEM WHO IS RECEIVING AN ORDINARY DISABILITY RETIREMENT
ALLOWANCE, IF AT THE TIME OF RETIREMENT THE RETIREE WAS A LAW
ENFORCEMENT OFFICER FOR A PARTICIPATING EMPLOYER UNDER § 26-201(A) OF
THIS ARTICLE.
