Ch. 452 2006 LAWS OF MARYLAND
CHAPTER 452
(House Bill 204) AN ACT concerning Assisted Living Program Facilities - Emergency Electrical Power Generator FOR the purpose of requiring the Department of Health and Mental Hygiene to
require certain facilities offering assisted living program services to have a
certain emergency electrical power generator on the premises; providing for the
power and system requirements of the emergency power generator; requiring a
facility to conduct a certain test of the emergency power generator a certain
number of times each month; requiring an emergency power system to provide
lighting to certain areas in a facility; requiring emergency electrical power to be
provided to certain areas and equipment; requiring certain facilities to provide
common areas or areas of refuge for certain patients under certain
circumstances; requiring the Department to adopt certain regulations regarding
common areas and areas of refuge; exempting certain facilities from the
requirements of this Act under certain circumstances; authorizing the
Department to grant a certain waiver or waiver extension to certain "facilities
under certain circumstances for a certain period of time; requiring the
Department to review certain waivers each year: providing for a delayed
effective date; and generally relating to assisted living program facilities and
emergency electrical power generators. BY adding to Article - Health - General
Section 19-1808
Annotated Code of Maryland
(2005 Replacement Volume and 2005 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Health - General 19-1808. (A)     EXCEPT AS PROVIDED IN SUBSECTION SUBSECTIONS (G) AND (H) OF THIS
SECTION, THE DEPARTMENT SHALL REQUIRE THAT EACH ASSISTED LIVING
PROGRAM FACILITY THAT PROVIDES SERVICES TO 50 OR MORE INDIVIDUALS HAVE
AN EMERGENCY ELECTRICAL POWER GENERATOR ON THE PREMISES. (B)     THE DEPARTMENT SHALL REQUIRE THAT EACH FACILITY PROVIDE
EMERGENCY ELECTRICAL POWER AS PROVIDED IN THIS SECTION. (C)     (1) THE EMERGENCY POWER SOURCE SHALL BE A GENERATING SET
AND PRIME MOVER LOCATED ON THE FACILITY PREMISES WITH AUTOMATIC
TRANSFER. - 2340 -
