SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Courts and Judicial Proceedings
3-8A-01.
(a) In this subtitle the following words have the meanings indicated, unless
the context of their use indicates otherwise.
(z) "Qualified expert" means [a licensed psychologist or psychiatrist who has
expertise in child development, with training in forensic evaluation procedures
through formal instruction, professional supervision, or both, and who is:
(1) Familiar with the competency standards contained in this subtitle;
and
(2) Familiar with the treatment, training, and restoration programs for
children that are available in this State] A LICENSED CERTIFIED SOCIAL
WORKER CLINICAL, LICENSED PSYCHOLOGIST; OR LICENSED PSYCHIATRIST WHO:
(1) (I) HAS EXPERTISE IN CHILD DEVELOPMENT, WITH TRAINING IN
THE FORENSIC EVALUATION OF CHILDREN, AS APPROVED BY THE SECRETARY OF
HEALTH AND MENTAL HYGIENE;
(2) (II) IS FAMILIAR WITH THE COMPETENCY STANDARDS CONTAINED
IN THIS SUBTITLE; AND
(3) (III) IS FAMILIAR WITH THE TREATMENT, TRAINING, AND
RESTORATION PROGRAMS FOR CHILDREN THAT ARE AVAILABLE IN THIS STATE.
