2. The petition may be brought at any time, except that it
may not be later than the third Tuesday preceding the next succeeding election. (ii) 1. The court, on presentation of satisfactory evidence, may, in
its discretion, dispose of the matter summarily or otherwise set the matter for
hearing. 2. On appropriate order of the court, the State Board shall
make the required corrections. (d) (1) An appeal may be taken from any ruling of the circuit court to the
Court of Special Appeals. (2) The appeal shall be taken within 5 days from the date of the decision
by the circuit court, and the appeal shall be heard and decided by the Court of Special
Appeals as soon after the transmission of the record as practicable. SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health
or safety, has been passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two Houses of the General Assembly, and shall take
effect from the date it is enacted. Approved May 2, 2006.
CHAPTER 355
(House Bill 813) AN ACT concerning Procurement— Contracts for Residential Child Care Programs FOR the purpose of requiring the Governor's Office for Children to develop the State
Resource Plan for Residential Child Care Programs in consultation with certain
agencies, providers, and local jurisdictions counties, child advocates, and
consumers; declaring the intent of the General Assembly; establishing the
content of the Plan; requiring that the Plan be issued and updated on or before
a certain date;
requiring the Governor's Office for Children to issue a certain
report on or before a certain date; establishing certain requirements for certain
contracts between certain agencies and providers; requiring a single point of
entry to provide certain sample contracts to potential providers; requiring the
Governor's Office for Children members of the Children's Cabinet to adopt
certain regulations; defining certain terms; and generally relating to
procurement for residential child care programs. BY adding to ArticleState Finance and Procurement Section 13-501 through 13-506, inclusive, to be under the new subtitle "Subtitle
5. Contracts for Residential Child Care Programs"
