Ch. 283 2006 LAWS OF MARYLAND
(i) a criminal offense incident to obtaining, attempting to obtain, or
performing a public or private contract, except as provided in § 16-202; or (ii) fraud, embezzlement, theft, forgery, falsification or destruction
of records, or receiving stolen property; (2)     been convicted of a criminal violation of an antitrust statute of the
State, another state, or the United States; (3)     been convicted of a violation of the Racketeer Influenced and Corrupt
Organization Act, or the Mail Fraud Act, for acts in connection with the submission of
bids or proposals for a public or private contract; (4)     been convicted of a violation of § 14-308 of this article; (5)     been convicted of conspiracy to commit any act or omission that
would constitute grounds for conviction under any of the laws or statutes described in
paragraphs (1), (2), (3), or (4) of this subsection; [or] (6)     been found civilly liable under an antitrust statute of the State,
another state, or the United States for acts or omissions in connection with the
submission of bids or proposals for a public or private contract; OR (7)      BEEN FOUND IN A FINAL ADMINISTRATIVE ADJUDICATED DECISION
TO HAVE VIOLATED THE COMMERCIAL NONDISCRIMINATION POLICY UNDER TITLE
19 OF THIS ARTICLE WITH REGARD TO A PUBLIC OR PRIVATE CONTRACT. TITLE 19. COMMERCIAL NONDISCRIMINATION POLICY.
19-101. (A)     IT IS THE POLICY OF THE STATE NOT TO ENTER INTO A CONTRACT WITH
ANY BUSINESS ENTITY THAT HAS DISCRIMINATED IN THE SOLICITATION,
SELECTION, HIRING, OR COMMERCIAL TREATMENT OF VENDORS, SUPPLIERS,
SUBCONTRACTORS, OR COMMERCIAL CUSTOMERS ON THE BASIS OF SEX, RACE, AGE,
COLOR, CREED, OR NATIONAL ORIGIN,
RACE, COLOR, RELIGION, ANCESTRY OR
NATIONAL ORIGIN, SEX, AGE, MARITAL STATUS, SEXUAL ORIENTATION, OR ON THE
BASIS OF DISABILITY OR ANY OTHERWISE UNLAWFUL USE OF CHARACTERISTICS
REGARDING THE VENDOR'S, SUPPLIER'S, OR COMMERCIAL CUSTOMER'S EMPLOYEES
OR OWNERS. (B)     NOTHING IN THIS TITLE SHALL BE CONSTRUED TO PROHIBIT OR LIMIT
OTHERWISE LAWFUL EFFORTS TO REMEDY THE EFFECTS OF DISCRIMINATION THAT
HAVE OCCURRED OR ARE OCCURRING IN THE MARKETPLACE. (C) CONDUCT THAT HAS OCCURRED MORE THAN 4 YEARS PRIOR TO THE
FILING OF A COMPLAINT ABOUT CONDUCT THAT IS NOT ACTIONABLE UNDER THIS
TITLE MAY NOT BE SUBJECT TO THE FILING OF A COMPLAINT NOR BE SUBJECT TO
THE IMPOSITION OF SANCTIONS OR REMEDIES UNDER THIS TITLE.
(C) A COMPLAINT OF DISCRIMINATION SHALL BE FILED WITHIN 4 YEARS
AFTER THE DATE THE CAUSE OF ACTION ACCRUES. - 1582 -
