(Senate Bill 794)
AN ACT concerning
Procurement - eMaryland Marketplace
FOR the purpose of authorizing the Department of Budget and Management to
establish fees for the use of eMaryland Marketplace by certain entities;
prohibiting the Department from charging a unit a fee under certain
circumstances; repealing certain procedures for deducting and retaining certain
fees to pay certain costs; providing for a delayed effective date; and generally
relating to Internet-based procurement and eMaryland Marketplace.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Finance and Procurement
13-102.1.
(A) A UNIT MAY NOT CHARGE A FEE TO ACCESS EMARYLAND MARKETPLACE.
(B) (1) THE DEPARTMENT OF BUDGET AND MANAGEMENT MAY ESTABLISH
FEES FOR THE USE OF EMARYLAND MARKETPLACE BY AN ENTITY THAT PUBLISHES
A NOTICE OF A PROCUREMENT, CONDUCTS A PROCUREMENT, OR PUBLISHES A
NOTICE OF AWARD.
(2) THE DEPARTMENT OF BUDGET AND MANAGEMENT MAY NOT
CHARGE A UNIT, AS DEFINED IN § 11-101(X) OF THIS ARTICLE, A FEE UNDER THIS
SUBSECTION.
13-103.
[(g) (1) A unit may not charge a fee to access eMaryland Marketplace.
(2) To pay the costs of operating eMaryland Marketplace, the unit shall
deduct and retain from the procurement contract price that was submitted by the
