(d) "Public improvement" includes any construction, maintenance, or repair of
any building, structure, or other public work:
(1) owned or constructed by the State or any unit of the State
government, including the University System of Maryland, St. Mary's College of
Maryland, and Morgan State University; or
|
|
|
|
|
|
|
|
|
|
(2) acquired or constructed in whole or in part with State funds.
|
|
|
|
|
|
|
|
|
|

|
|
|
(a) (1) Except as provided in § 4-409 of this subtitle, this subtitle does not
apply to any public improvement made by:
|
|
|
|
|
|
|
|
|
|
(i) (1) the Department of Transportation or a unit in that
|
|
|
|
|
|
|
|
|
|
Department;
Code;
Commission;
|
|
|
|
|
|
(ii) (2) any housing authority created under Article 44A of the
(iii) (3) the Maryland-National Capital Park and Planning
|
|
|
|
|
|
|
|
|
|
|
|
|
|
(iv) (4) the Washington Suburban Sanitary Commission;
(v) (5) the Baltimore County Metropolitan District;
(vi) (6) a county, municipal corporation, or unit of a county or
municipal corporation; [or]
(vii) (7) the University System of Maryland; OR
(VIII) (8) MORGAN STATE UNIVERSITY; OR
(9) ST. MARYS COLLEGE OF MARYLAND.
(2) Except as provided in §§ [4-406, 4-410, and 4-410.1] 4-406 AND
4-410.1 of this subtitle or as otherwise provided by law, St. Mary's College of Maryland
and Morgan State University are subject to the provisions of this subtitle.

(a) (1) [Except as provided in paragraph (4) of this subsection, the] THE
Department shall advise the Board of Public Works and any unit of the State
government in connection with any engineering question or matter concerning a
public improvement.
(2) The Department shall supervise any engineering question or matter
concerning a public improvement.
(3) Any contract, plan, or specification for any public improvement that
involves an engineering question:
