(d) (2) For wraparound services, payment or reimbursement may not be
provided in accordance with § 8-415(d) of this subtitle if:
(i) The child is eligible for funding for out-of-state placement of
children under [Article 49D, §§ 4.3 and 20.1 of the Code] DEPARTMENTAL
REGULATIONS; or
(ii) Alternative federal, State, or local funding is available.
(f) In addition to meeting the requirements of this subtitle, a local school
system seeking nonpublic tuition payment [must also meet the requirements of
Article 49D of the Code, as applicable, and] SHALL obtain funding approval from the
local coordinating council and the State Coordinating Council IN ACCORDANCE WITH
DEPARTMENTAL REGULATIONS.

(a) (4) "Individualized education program" and "IEP team" have the same
meaning as provided by the Individuals with Disabilities Education Act
[Amendments of 1997, P.L. 105-17, Section 614(d)].

(b) (2) If a local management board, AS established [under Article 49D, § 11
of the Code] BY THE GOVERNOR'S OFFICE FOR CHILDREN, funds the placement of a
child in a school that is outside the State or the county in which the child resides
without consulting the local school system, the local management board shall certify
and pay the cost of the student's daily or other reasonable transportation to school.
8-412.
(a) (1) In this section the following words have the meanings indicated.
(2) "Child" means an individual [under the age of 21] who IS ELIGIBLE
TO RECEIVE EDUCATION SERVICES IN ACCORDANCE WITH THE INDIVIDUALS WITH
DISABILITIES EDUCATION ACT AND APPLICABLE STATE LAW AND REGULATION [:
(i) Has been determined through appropriate procedures to be
disabled and in need of special education; or
(ii) Is believed to be disabled and in need of special education].
(3) "Educational decision making process" means all procedures relating
to the identification, evaluation, or educational placement of a child and the provision
of a free appropriate public education, including the appeal procedures provided for
by § 8-413 of this subtitle.
(4) "Local school superintendent" means the school system
superintendent or [any individual] THE ADMINISTRATIVE HEAD in charge of a
[system or program] PUBLIC AGENCY AS DEFINED IN PARAGRAPH (7) OF THIS
SUBSECTION that provides educational services to children.
