ROBERT L. EHRLICH, JR., Governor                             Ch. 216 SECTION 45. AND BE IT FURTHER ENACTED. That $100,000 of the general
fund appropriation for M00A01.01 - Executive Direction, and $100,000 of the general
fund appropriation for N00A01.01 - Office of the Secretary, and $100,000 of the
general fund appropriation for V00D01.01 - Office of the Secretary may not be
expended until: (1) the Department of Health and Mental Hygiene (DHMH), the Department
of Human Resources (DHR), and the Department of Juvenile Services
(DJS) submit a report to the budget committees beginning July 15, 2006,
listing by provider, the number of incidents and deficiencies noted by
licensed child residential group home licensing monitors in the previous
three months. This report should be submitted quarterly thereafter; and (2) DHMH, DHR, and DJS report back to the budget committees on the
feasibility of establishing a procedure for the collection of local police
incident reports concerning incidents involving licensed child residential
group homes. The budget committees shall have 45 days to review and comment on the report. SECTION 46. AND BE IT FURTHER ENACTED, That $100,000 of the general
fund appropriation for R00A01.01 - Office of the State Superintendent-Headquarters
may not be expended until: (1) the Maryland State Department of Education, in consultation with the
Governor's Office for Children, submits to the budget committees by
October 1, 2006, a status report on the implementation of Chapter 217,
Acts of 2003 and Chapter 308, Acts of 2005. The report shall describe
current policies and regulations relating to the enrollment of children in
State-supervised care in the local school system and procedures and
timelines adopted for the transfer of their educational records. The report
shall identify any specific barriers to the expeditious enrollment of these
children and the transfer of records and propose options for addressing
those barriers; and (2) the budget committees have reviewed and commented on the report or 45
days have elapsed from the date the committees received the report. SECTION 47. AND BE IT FURTHER ENACTED, That $100,000 of the general
fund appropriation for M00A01.01 - Executive Direction may not be expended until: (1) the Department of Health and Mental Hygiene, in consultation with the
Governor's Office for Children, submits to the budget committees by
October 1, 2006, a status report on the implementation of Chapter 438.
Acts of 2004. The status report shall detail both the progress made to date
and specific timelines for future actions to make the State Board for Certification of Residential Child Care Program Administrators operational. The report shall address how the department will ensure that
all residential child care program administrators will be identified and
certified by October 1. 2007; and
