HARRY HUGHES, Governor
FOR the purpose of authorizing the Board of Contract Appeals to
administer oaths or affirmations, certify official acts,
issue certain subpoenas and orders relating to the discovery
of evidence in matters before the Board; authorizing the
Board to compel testimony of witnesses; providing for
judicial enforcement of orders and subpoenas of the Board;
providing that a person who willfully makes, or procures
another to make, certain false statements in certain matters
before the Board is guilty of perjury or subornation of
perjury, respectively, and is subject to penalties upon
conviction in accordance with law. BY adding to Article 21 - Procurement Section 7-202(d), (e) and (f) Annotated Code of Maryland (1981 Replacement Volume and 1982 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article 21 - Procurement 7-202. (D) IN CONNECTION WITH ANY PROCEEDING AUTHORIZED BY THIS
SUBTITLE, THE APPEALS BOARD MAY: (1)  ADMINISTER OATHS OR AFFIRMATIONS; (2)  CERTIFY TO ALL OFFICIAL ACTS; AND (3) AT THE REQUEST OF A PARTY TO A PROCEEDING, ISSUE SUBPOENAS AND ORDERS FOR THE ATTENDANCE AND TESTIMONY OF WITNESSES, THE PRODUCTION OF PAPERS, BOOKS, PAYROLLS, ACCOUNTS,
RECORDS, OR OTHER DOCUMENTS OR OTHER MATTERS RELATED TO THE
DISCOVERY OF EVIDENCE. (E) (1) IF A PERSON FAILS TO COMPLY WITH ANY SUBPOENA OR
ORDER ISSUED UNDER THIS SECTION, THE APPEALS BOARD MAY INVOKE THE
AID OF A COURT OF COMPETENT JURISDICTION. (2) THE COURT MAY ORDER THAT PERSON TO OBEY THE
SUBPOENA OR ORDER OR TO GIVE BEFORE THE APPEALS BOARD
ABOUT THE MATTER IN QUESTION. (F) (1) ANY PERSON WHO WILLFULLY MAKES A FALSE STATEMENT,
UNDER OATH OR AFFIRMATION, CONCERNING MATTERS MATERIAL TO AN
ISSUE BEFORE THE BOARD, OR WHO PROCURES ANOTHER TO MAKE A
FALSE STATEMENT IN VIOLATION OF THIS SUBSECTION, IS GUILTY OF
PERJURY OR SUBORNATION OF PERJURY, AS THE CASE MAY BE.
