FOR the purpose of requiring persons who believe that a patient
or resident in a certain related institution has been abused
to report the abuse to an appropriate law enforcement
agency, the Secretary of the State Department of Health and
Mental Hygiene, or to the Office on Aging; requiring the
recipient of the report to inform the other parties and,
under certain circumstances, the administrator of the
related institution; redefining certain terms; providing for
the assistance of the Secretary in investigating reported
abuses; providing for the referral of certain cases to the
Secretary for investigation; providing for a written
investigation report to be sent to the local ombudsman;
granting immunity from civil liability to certain persons;
and generally relating to patient abuse in related
institutions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health - General
19-301.
(1) (1) "Related institution" means an organized
institution, environment, or home that:
(i) Maintains conditions or facilities and
equipment to provide domiciliary, personal, or nursing care for 2
or more unrelated individuals who are dependent on the
administrator, operator, or proprietor for nursing care or the
subsistence of daily living in a safe, sanitary, and healthful
environment; and
(ii) Admits or retains the individuals for
overnight care.
(2) "Related institution" does not include:

(i) An adult residential environment or home
that is certified by the Department of Human Resources;

|
|
|
