AN ACT concerning
Procurement - Purchases from
Minority Businesses
FOR the purpose of continuing until a certain date the provisions
of the State Procurement Law relating to purchases from
minority businesses; altering the composition of the
agencies covered by the 10 percent purchase goal; specifying
that agencies not covered by the 10 percent goal shall
structure their procurement procedures in a certain manner;
specifying certain reporting requirements; requiring the
Board of Public Works to adopt certain regulations; and
generally relating to procurements by the State from
minority business enterprises.
BY repealing and reenacting, with amendments,

Preamble
WHEREAS, The General Assembly of Maryland enacted Chapter
575 of 1978 for the purposes set out in the Preamble of that
enactment (which Preamble is incorporated by reference in this
enactment) and in order to bring greater numbers of
minority-owned businesses into the State's procurement process;
and
WHEREAS, That law has resulted in substantial increases in
the number and total dollar amounts of State procurement
contracts or subcontracts being let to businesses owned and
operated by members of certain socially or economically
disadvantaged population groups; and
WHEREAS, The General Assembly believes that the Minority
Business Law should be continued for at least 5 more years, but
with annual oversight by appropriate committees of the General
Assembly; and
WHEREAS, All State agencies that contract for services,
supplies, or construction should take steps to encourage
participation by minority businesses in their procurement
procedures; now, therefore,
