serving in any salaried public office or position as above
enumerated, should thereafter relinquish such office or position
and notify the county executive of Prince George's County of such
fact, then, from and after the date of such notification, the
judge shall be entitled to all the benefits as provided by this
subsection. The County Council of Prince George's County is
hereby expressly authorized to levy for and pay pensions and
salaries to former judges of the People's Court who served on the
court upon the terms and for the periods as herein provided; and
any provision heretofore made is hereby ratified and confirmed. (3) A judge who became a judge of the District Court
pursuant to Article IV, § 41-I[(g)] (A) of the Constitution, or
the surviving spouse of such a judge, may elect to receive the
benefits provided by this subsection, or the benefits provided by
§ 62 of this article. 66. (b) The term "State employees," as used in this subtitle
means those officers and employees of the State of Maryland who
are paid through the Central Payroll Bureau or are authorized to
be paid through the Central Payroll Bureau pursuant to § 38A of
Article 64A, as added by Chapter 255 of the Acts of 1973. It
includes members of the General Assembly, judges of the Court of
Appeals, the Court of Special Appeals, the various circuit
courts, the District Court, the Maryland Tax Court, and the
various orphans' courts, and part-time and contractual employees
paid through the Central Payroll Bureau or authorized to be paid
through the Central Payroll Bureau by § 38A of Article 64A. The
term "State employees" also includes the clerks of the courts in
all counties and Baltimore City and all employees in the office
of the clerks of courts; and all registers of wills in all
counties and Baltimore City and all employees in the office of
the register of wills; and all contractual employees of the State
of Maryland, whether or not they are paid through the Central
Payroll Bureau or authorized to be paid through the Central
Payroll Bureau by § 38A of Article 64A. In all cases of doubt as
to whether a person is to be eligible for participation in the
deferred compensation plan, the board of trustees that
administers this plan shall determine whether any person is a
State employee as defined in this subtitle irrespective [or] OF
the method of payment. 72. For the purposes of this subtitle: (6) The term "plan" means the Employees' Retirement
System, the Teachers' Retirement System, the State Police
Retirement System, the Employees' Pension System, and the
Teachers' Pension System, including any system or subsystems of
these systems, or any [systems] SYSTEM administered by the board
of trustees of the plans.
