PART V. PREMIUMS AND FEES.
13-136.
(A) THE AUTHORITY MAY, IN ITS SOLE AND ABSOLUTE DISCRETION,
SET THE PREMIUMS AND FEES TO BE PAID TO IT FOR PROVIDING
FINANCIAL ASSISTANCE UNDER THIS SUBTITLE.
(B) THE PREMIUMS AND FEES SET BY THE AUTHORITY SHALL BE
PAYABLE IN THE AMOUNTS, AT THE TIME AND IN THE MANNER THAT THE
AUTHORITY, IN ITS SOLE AND ABSOLUTE DISCRETION, REQUIRES.
(C) THE PREMIUMS AND FEES NEED NOT BE UNIFORM AMONG
TRANSACTIONS, AND MAY VARY IN AMOUNT:

|
(1) AMONG TRANSACTIONS; AND
(2) AT DIFFERENT STAGES DURING THE TERMS OF
TRANSACTIONS.
(D) A DETERMINATION BY THE AUTHORITY IN ACCORDANCE WITH
THIS PART V, SHALL REMAIN EFFECTIVE THROUGHOUT THE PERIOD DURING
WHICH THE FINANCIAL ASSISTANCE PROVIDED BY THE AUTHORITY IS IN
EFFECT.
13-137.
(A) IN GENERAL. - THE AUTHORITY MAY NOT CHARGE ANY PREMIUM
FOR INSURANCE IF THE AUTHORITY DETERMINES THAT AT THE TIME OF
APPROVAL OF INSURANCE, THE FACILITY, ENERGY PROJECT, OR BUSINESS
WITH RESPECT TO WHICH INSURANCE IS PROVIDED BY THE AUTHORITY IS
LOCATED IN A COUNTY WHERE THE AVERAGE UNEMPLOYMENT RATE IS AT
LEAST 1 PERCENT GREATER THAN THE AVERAGE UNEMPLOYMENT RATE FOR
THE UNITED STATES, AS DETERMINED IN ACCORDANCE WITH THIS SECTION.
(B) STANDARDS FOR UNEMPLOYMENT RATES. -
(1) AVERAGE UNEMPLOYMENT RATES FOR A COUNTY SHALL BE
THOSE ESTABLISHED BY THE STATE EMPLOYMENT SECURITY ADMINISTRATION
OR ANY OTHER AGENCY OR INSTRUMENTALITY RESPONSIBLE FOR
ESTABLISHING THE RATES.
(2) AVERAGE UNEMPLOYMENT RATES FOR THE UNITED STATES
SHALL BE THOSE ESTABLISHED BY THE UNITED STATES DEPARTMENT OF
LABOR OR ANY OTHER AGENCY OR DEPARTMENT RESPONSIBLE FOR
ESTABLISHING THE RATES.
(C) REVIEW OF RATES. - THE AUTHORITY SHALL:
(1) ANNUALLY REVIEW THE UNEMPLOYMENT RATES; AND
(2) ONLY CONSIDER ANNUAL UNEMPLOYMENT RATES
ESTABLISHED NOT MORE THAN 12 MONTHS BEFORE THE DATE OF THE
AUTHORITY'S REVIEW.
