548 LAWS OF MARYLAND Ch. 71
(4) "Regular benefits" means benefits payable to an
individual under this act pursuant to Section 3(d)(1), but not
additional benefits pursuant to Section [3(d)(2)] 23, or under
any other State law (including benefits payable to federal
civilian employees and to ex-servicemen pursuant to 5 U.S.C.
chapter 85) [other than], OR extended benefits. SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 23,
24, and 25, respectively, of Article 95A - Unemployment Insurance
Law, of the Annotated Code of Maryland be renumbered to be
Section(s) 24, 25, and 26, respectively. SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows: Article 95A - Unemployment Insurance Law 23. (A)  EXCEPT AS PROVIDED IN SUBSECTION (D), WITH RESPECT TO
UNEMPLOYMENT WHICH OCCURS DURING AN ADDITIONAL BENEFIT PERIOD,
ANY INDIVIDUAL WHO IS ELIGIBLE UNDER THIS SECTION SHALL BE
ENTITLED TO A TOTAL AMOUNT OF ADDITIONAL BENEFITS NOT TO EXCEED
13 TIMES THE INDIVIDUAL'S BASIC WEEKLY BENEFIT AMOUNT IN THE
INDIVIDUAL'S ELIGIBILITY PERIOD AS DEFINED IN THIS SECTION. FOR
EACH WEEK DURING WHICH ADDITIONAL BENEFITS ARE PAYABLE IN ANY
AMOUNT, THE CLAIMANT SHALL BE ENTITLED TO ALLOWANCES FOR
DEPENDENTS, WHICH ALLOWANCES SHALL NOT BE DEDUCTED FROM THE
CLAIMANT'S TOTAL ENTITLEMENT TO ADDITIONAL BENEFITS. (B)  (1) AN ADDITIONAL BENEFIT PERIOD BEGINS THE THIRD WEEK
AFTER AN "ON" INDICATOR FOR ADDITIONAL BENEFITS IS IN EFFECT AND
ENDS THE THIRD WEEK AFTER AN "OFF" INDICATOR FOR ADDITIONAL
BENEFITS IS IN EFFECT. PROVIDED, HOWEVER, THAT AN ADDITIONAL
BENEFIT PERIOD MAY NOT END BEFORE THE 13TH CONSECUTIVE WEEK OF
SUCH PERIOD EXCEPT AS PROVIDED IN SUBPARAGRAPH (2)(II) AND MAY
NOT BEGIN BEFORE THE 14TH WEEK FOLLOWING THE END OF A PRIOR
ADDITIONAL BENEFIT PERIOD. (2) (I) THERE IS AN ADDITIONAL BENEFITS "ON"
INDICATOR FOR A WEEK IF FOR A PERIOD THAT CONSISTS OF THE WEEK
AND THE 12 IMMEDIATELY PRECEDING WEEKS, THE RATE OF INSURED
UNEMPLOYMENT (NOT SEASONALLY ADJUSTED) EQUALED OR EXCEEDED 12 0
PERCENT OF THE AVERAGE OF THE RATES FOR THE CORRESPONDING 13 WEEK
PERIOD ENDING IN EACH OF THE 2 PRECEDING CALENDAR YEARS AND
EQUALED OR EXCEEDED 4 PERCENT. AFTER A STATE "ON" INDICATOR
OCCURS UNDER THIS SUBPARAGRAPH, THERE IS A STATE "OFF" INDICATOR
FOR A WEEK, IF FOR A PERIOD THAT CONSISTS OF THE WEEK AND THE 12
IMMEDIATELY PRECEDING WEEKS, THE RATE OF INSURED UNEMPLOYMENT
(NOT SEASONALLY ADJUSTED) WAS LESS THAN 120 PERCENT OF THE
AVERAGE OF THE RATES FOR THE CORRESPONDING 13 WEEK PERIOD ENDING
IN EACH OF THE 2 PRECEDING CALENDAR YEARS OR WAS LESS THAN 4
PERCENT.
