ALLOCATE THE 911 FEE AMONG THE SEPARATE ACCOUNTS MAINTAINED IN
THE 911 TRUST FUND FOR EACH COUNTY. REVENUES FROM THE 911 FEE
SHALL BE COLLECTED BY THE TELEPHONE COMPANIES ON A COUNTY BASIS
AND REMITTED MONTHLY TO THE COMPTROLLER FOR DEPOSIT IN THE 911
TRUST FUND ACCOUNT MAINTAINED FOR THE COUNTY IN WHICH THE 911 FEE
WAS COLLECTED. [(c) The Secretary, with the advice of the Board shall
prepare the fiscal requirements to carry out the provisions of
this subtitle. Upon approval of the fiscal requirements by the
General Assembly, the Public Service Commission shall establish
the amount of the fee for the ensuing fiscal year. The
Comptroller shall maintain the method of collection of the fee
proceeds from the companies and the collections shall accrue to
the Fund.] (C) IN ADDITION TO THE 911 FEE IMPOSED BY § 204H-5
204H-5(B), THE GOVERNING BODY OF EACH COUNTY MAY BY ORDINANCE OR
RESOLUTION AFTER PUBLIC HEARING ENACT OR ADOPT AN ADDITIONAL
CHARGE NOT TO EXCEED 30 CENTS PER MONTH TO BE APPLIED TO ALL
CURRENT BILLS RENDERED FOR TELEPHONE SWITCHED LOCAL EXCHANGE
ACCESS SERVICE WITHIN THAT COUNTY. THE AMOUNT OF THE ADDITIONAL
CHARGE MAY NOT EXCEED A LEVEL NECESSARY TO COVER THE TOTAL AMOUNT
OF APPROVED ELIGIBLE OPERATION AND MAINTENANCE COSTS OF THE
COUNTY. BEFORE JULY 1 OF EACH YEAR, THE COUNTY SHALL CERTIFY THE
AMOUNT OF THE ADDITIONAL CHARGE TO THE PUBLIC SERVICE COMMISSION
WHICH ON 60 DAYS NOTICE SHALL DIRECT THE TELEPHONE COMPANIES TO
ADD THE FULL AMOUNT OF THE ADDITIONAL CHARGE TO ALL CURRENT BILLS
RENDERED FOR TELEPHONE SWITCHED LOCAL EXCHANGE ACCESS SERVICE IN
EACH COUNTY WHICH IMPOSED THAT ADDITIONAL CHARGE. THE TELEPHONE
COMPANIES SHALL ACT AS COLLECTION AGENTS FOR THE 911 TRUST FUND
WITH RESPECT TO THE ADDITIONAL CHARGES IMPOSED BY EACH COUNTY.
REVENUES FROM THE SURCHARGE ADDITIONAL CHARGE SHALL BE COLLECTED
BY THE TELEPHONE COMPANIES ON A COUNTY BASIS AND REMITTED MONTHLY
TO THE COMPTROLLER FOR DEPOSIT TO THE 911 TRUST FUND ACCOUNT
MAINTAINED FOR THE COUNTY WHICH IMPOSED THE ADDITIONAL CHARGE. (d) The Secretary shall administer the [Fund] 911 TRUST
FUND subject to the provisions for financial management and
budgeting established by the Department of Budget and Fiscal
Planning. THE SECRETARY SHALL CAUSE THE COMPTROLLER TO ESTABLISH
SEPARATE ACCOUNTS FOR THE PAYMENT OF ADMINISTRATIVE EXPENSES AND
FOR EACH COUNTY WITHIN THE 911 TRUST FUND. THE INCOME DERIVED
FROM INVESTMENT OF MONEY IN THE FUND SHALL ACCRUE TO THE FUND AND
THE COMPTROLLER SHALL ALLOCATE INVESTMENT INCOME AMONG THE
ACCOUNTS IN THE FUND ON A FAIR AND EQUITABLE BASIS PRO RATED ON
THE BASIS OF THE TOTAL FEES COLLECTED IN EACH COUNTY. (E) THE COMPTROLLER SHALL DISBURSE THE MONEYS IN THE 911
TRUST FUND AS PROVIDED IN THIS SUBSECTION. (1) EACH JULY 1, THE COMPTROLLER SHALL ALLOCATE
SUFFICIENT REVENUES FROM THE 911 FEE TO PAY THE COSTS OF
ADMINISTERING THE 911 TRUST FUND AS PROVIDED BY LAW.
