and Training Act, the Federal Jobs Training Partnership Act, and
any executive orders issued to implement those Acts, are hereby
transferred to the Department of Labor, Employment and Training
on the effective date of this Act.
SECTION 4. AND BE IT FURTHER ENACTED, That the Department
of Human Resources and the Department of Licensing and Regulation
and other appropriate State agencies shall immediately begin to
take the necessary actions to complete the orderly transfer of
responsibilities and functions to the Department of Labor,
Employment and Training pursuant to this order on October 1,
1983. Such actions shall include the transfer and creation of
appropriate positions; mutually agreeable arrangements concerning
equipment and furniture, including data processing resources; the
transfer of records and accounts; and furnishing information to
the appropriate government agencies and to the public concerning
the transfer of responsibilities and functions pursuant to this
Act.
SECTION 5. AND BE IT FURTHER ENACTED, That all employees or
officials of the Departments of Human Resources and Licensing and
Regulation who are performing the functions transferred to the
Department of Labor, Employment and Training and whose positions
are transferred to that Department by this Act, including those
employees performing general functions for the Department of
Human Resources necessary for the operation of the Department of
Labor, Employment and Training, as determined by Secretaries of
Human Resources and Labor, Employment and Training, are hereby
transferred to the Department of Labor, Employment and Training
without any change or loss of rights or status, and without
further examination, qualification, or probationary period, and
these employees and officials shall retain their merit system and
retirement system status, except as otherwise specifically
provided in this Act. Such officials and employees shall not
suffer any diminution of salary, wages, accrued leave, or
seniority rights and status as a result of such transfer.
SECTION 6. AND BE IT FURTHER ENACTED, That, except as
otherwise provided in this Act, nothing in this Act affects the
term of office of an appointed member or official of any board,
commission, committee, or other agency or unit. A person who is
a member or official of such a unit on the effective date of this
Act shall remain a member for the balance of the term to which he
was appointed, unless the person sooner dies, resigns, or is
removed pursuant to the provisions of law.
SECTION 7. AND BE IT FURTHER ENACTED, That, except as
expressly provided to the contrary in this Act, any transaction
affected by or flowing from any statute here amended, repealed,
or transferred, and validly entered into before the effective
date of this Act and every right, duty, or interest flowing from
