EXECUTIVE ORDER OF JULY 1, 1982

STATE COORDINATING COUNCIL ON SERVICES TO HANDICAPPED CHILDREN
WHEREAS, The State Coordinating Committee on Services to
Handicapped Children was established by Executive Order
01.01.1978.07, as amended by Executive Order 01.01.1979.17,
to accomplish certain tasks, including the formulation of
recommendations to the Governor on procedures for the
placement of and funding for handicapped children in
non-public facilities; and
WHEREAS, The State Coordinating Committee on Services to
Handicapped Children has developed a uniform, coordinated,
State-wide procedure for the placement of and the
determination of funding of programs for handicapped
children requiring residential placement; and
WHEREAS, The State Coordinating Committee on Services to
Handicapped Children has recommended the implementation of
these procedures; and
WHEREAS, These procedures are designed to implement the following
existing programs being administered individually by the
Department of Health and Mental Hygiene, the Department of
Human Resources, and the State Board of Education:
(1) The purchase of services for handicapped children from
private agencies or organizations by the Juvenile
Services Administration pursuant to Section 6-113 of
the Health-General Article;
(2) The purchase of services for handicapped children from
persons by the Mental Retardation and Developmental
Disabilities Administration pursuant to Section
7-204(e) of the Health-General Article;
(3) The providing of foster care for children and care,
diagnosis, training, education, and rehabilitation of
children in group homes and institutions operated by
non-profit charitable corporations by the Department of
Human Resources pursuant to Article 88A, Sections 32C
and 61 of the Annotated Code of Maryland; and
(4) The placement of children in need of special
educational services in appropriate non-public
educational programs that offer these services pursuant
to Section 8-409 of the Education Article and the
Education of the Handicapped Act, §§ 611 through 620,
as amended, 20 U.S.C.A. §§ 1411 through 1420; and

WHEREAS, The Governor has the power under Article II, Section 24
of the Maryland Constitution and Article 41, Section 15C of
|
|
|
|
|
|
|
|
|
