2274 JOINT RESOLUTIONS
WHEREAS, States are better suited to understand the
insurance needs of their citizens; and
WHEREAS, Therefore, states should be allowed to continue to
regulate all insurance policies covering their citizens,
including insurance policies regulated by Employment Employee
Retirement Income Security Act; now, therefore, be it and
WHEREAS, Congress has exempted Hawaii's Prepaid Health Care
Act from the Employee Retirement Income Security Act (ERISA);
now, therefore, be it
RESOLVED BY THE GENERAL ASSEMBLY OF MARYLAND, That Congress
is urged to introduce and pass amendments to legislation to amend
the preemption clause of the Employment Employee Retirement
Income Security Act (ERISA) to permit states to regulate the
benefits provided by employee health benefits plans; and be it
further
RESOLVED, That a copy of this Resolution be sent to the
Maryland Congressional Delegation: Senators Charles McC. Mathias,
Jr. and Paul S. Sarbanes, Senate Office Building, Washington,
D.C. 20510; and Representatives Royden P. Dyson, Clarence D.
Long, Barbara A. Mikulski, Marjorie S. Holt, Steny H. Hoyer,
Beverly B. Byron, Parren J. Mitchell, and Michael D. Barnes,
House Office Building, Washington, D.C. 20515; and Raymond J.
Donovan, Secretary of Labor, United States Department of Labor,
200 Constitution Avenue, N.W., Washington, D.C. 20210, who is
requested to send copies of this Resolution to all state
insurance commissioners or officials who are responsible for
regulating insurance in the other 49 states.

A Senate Joint Resolution concerning
Community Based Service Programs for the Elderly
FOR the purpose of requesting the State Department of Health and
Mental Hygiene to apply to the Secretary of the U.S.
Department of Health and Human Services for a waiver,
pursuant to Title XIX of the federal Social Security Act (as
amended), to provide funding for community based service
programs for the elderly.
WHEREAS, The General Assembly of Maryland recognizes that
many elderly citizens of Maryland are inappropriately placed or
