2222                                             LAWS OF MARYLAND                                        Ch. 677 (3) Such areas shall be referred to as "Real Estate
Conservation Areas." (B) THE STANDARD OF PROOF IN AN ACTION BY THE REAL ESTATE
COMMISSION TO MODIFY OR , REMOVE, OR RENEW A SUSPENSION IMPOSED
UNDER SUBSECTION (A)(1) OF THIS SECTION IN A REAL ESTATE
CONSERVATION AREA IS A , THE COMMISSION SHALL MAKE ITS
DETERMINATION BASED ON THE PREPONDERANCE OF THE EVIDENCE. (C)   IN AN ACTION TO MODIFY OR , REMOVE, OR RENEW A
SUSPENSION IMPOSED UNDER SUBSECTION (A)(1) OF THIS SECTION, THE
REAL ESTATE COMMISSION SHALL DETERMINE WHETHER: (1)  THE SUSPENSION ADVANCES A STATE INTEREST; (2)  THERE IS A REASONABLE BASIS TO BELIEVE THAT PANIC
SELLING, BLOCK BUSTING, OR DEPRESSED REAL ESTATE MARKET VALUES
WILL OCCUR; AND (3)  THERE IS A LESS RESTRICTIVE ALTERNATIVE
AVAILABLE. (D)  WHEN THE REAL ESTATE COMMISSION CONSIDERS WHETHER TO
MODIFY OR , REMOVE, OR RENEW A SUSPENSION IMPOSED UNDER
SUBSECTION (A)(1) OF THIS SECTION, THE REAL ESTATE COMMISSION
SHALL PROVIDE INFORMATION TO THE COMMUNITY AFFECTED THAT
INCLUDES: (1)  THE RACIAL AND ECONOMIC COMPOSITION OF THE REAL
ESTATE CONSERVATION AREA; (2)  THE NUMBER OF REAL ESTATE TRANSACTIONS IN THE
AREA; AND (3)  THE FAIR MARKET VALUES OF PROPERTIES AFFECTED. [(b)] (E) Any person aggrieved by the suspension may seek a
review thereof by the circuit court of any county. [(c)] (F) Any person, firm, partnership, corporation, or
association who or which violates the terms of suspension order
issued by the Commission is guilty of a misdemeanor and upon
conviction thereof is subject to a fine of not more than [one
thousand dollars ($1,000)] $1,000 or imprisonment for not more
than [one] 1 year, or both. [(d) The several sections and provisions of those sections
are declared to be independent of each other, and it is the
legislative intent that if any of these sections or provisions of
these sections is declared to be unconstitutional, the section or
provision of those sections shall not affect any other portions
of this section.]
