2194                                             LAWS OF MARYLAND                                        Ch. 672 CHAPTER 672 (Senate Bill 296) AN ACT concerning Natural Resources - Pursuit of Offenders Across
Maryland-Virginia Water Boundary FOR the purpose of allowing certain legally constituted
authorities in Maryland to pursue certain persons who have
committed certain offenses on the waters of the State of
Maryland across the border and into the Commonwealth of
Virginia; allowing certain legally constituted authorities
in Virginia to pursue certain persons who have committed
certain offenses on the waters of Virginia across the border
and into Maryland; providing for the effect of certain laws
where an offense occurs during the capture of persons under
continuous pursuit under this Act; and providing for certain
conditions concerning the effectiveness and duration of this
Act. BY adding to Article - Natural Resources Section 1-210 Annotated Code of Maryland (1974 Volume and 1982 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Natural Resources 1-210. (A) (1) WHEN, IN THE OPINION OF THE LEGALLY CONSTITUTED
AUTHORITIES OF MARYLAND, THERE HAS OCCURRED ON THE WATERS OF
MARYLAND A VIOLATION OF THIS ARTICLE, OR WHEN, IN THE OPINION OF
THE LEGALLY CONSTITUTED AUTHORITIES OF VIRGINIA, THERE HAS
OCCURRED ON THE WATERS OF VIRGINIA A VIOLATION OF THE LAWS OF
VIRGINIA ENFORCEABLE UNDER § 28.1-185 OR § 28.1-185.1, CODE OF
VIRGINIA, THE LEGALLY CONSTITUTED AUTHORITIES OF THE STATE IN
WHICH THE OFFENSE WAS COMMITTED MAY PURSUE THE OFFENDER UP TO AND
ACROSS THE MARYLAND-VIRGINIA BOUNDARY INTO THE STATE IN WHICH THE
OFFENDER FLEES. (2) IF A CAPTURE IS MADE IN CONTINUOUS PURSUIT UNDER
THE AUTHORITY OF PARAGRAPH (1) OF THIS SUBSECTION, THE OFFENDER,
VESSEL, AND PROPERTY SHALL BE DEALT WITH AS AUTHORIZED BY THE
LAWS OF THE STATE IN WHICH THE OFFENSE WAS COMMITTED.
